    Delivery shall be deemed to have been made by You to Professional Flaggers Association, LLC five (5) days after the date sent. PROFESSIONAL FLAGGERS ASSOCIATION, LLC: WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT The Professional Flaggers Association, LLC is hereby referred to as " PRO FLAGGERS" for the purpose of this document. IN CONSIDERATION for allowing any person or persons to participate in any way in any and all events or activities encompassed by this Agreement and/or permitting the person or persons to enter for any purpose any area of any racing facility world-wide the person or persons agree as follows: 1. THE PERSON OR PERSONS AND/OR GUARDIAN will immediately inspect all areas upon entering and warrant that their entry therein and their event participation constitutes an acknowledgement that they personally have inspected the area(s) and find it safe and reasonably suited for the purpose of its use. The undersigned agree that if any time in any area of any facility, they believe something is unsafe, it will be brought to the attention of a facility and/or event official and they will remove themselves from the area immediately and refuse further participation in the event or activity. 2. THE PERSON OR PERSONS AND/OR GUARDIAN HEREBY ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to the negligence of releasees (as identified below) or otherwise, while in or upon any area(s) for any purpose including competing, officiating, observing, working, photographing, televising, recording or participating in any event or activity, The PRO FLAGGERS customer(s) and/or worker(s) recognize and understand that there are substantial and real risks and dangers associated with observation of and participation in motorsports and related events and admission within any area(s) could cause severe bodily injury, disability, and death. Further, the risks and dangers may be caused by the negligent actions or negligent failure to act (gross or otherwise) of the releasees and others. All of the risks and dangers associated with participating in any event and entry into any area(s) may not be foreseeable at this time or in the future and they are assumed notwithstanding. 3. THE PERSON OR PERSONS AND/OR GUARDIAN, release, discharge, and covenant not to sue and waive all claims against Pro Flaggers, their owner(s), investor(s), associates and business partner(s), the promoters, participant, racing associations, sanctioning organizations (or any subdivision thereof), track operators, track owner or landowner, officials, car owners, drivers, pit crews, all persons in any area, sponsors, advertisers, lessees and Iessors of the premises used to conduct the event and their officers, agents, employees, all for the purposes herein referred to as releasees, from all liability to PRO FLAGGERS, the undersigned, or personal representatives, assigns, executors, heirs, and next of kin for any and all claims, demands, losses, or damages on account of any injury, including but not limited to the death of the PRO FLAGGERS customer and/or PRO FLAGGERS worker or damage to property, caused or alleged to be caused in whole or in part by the negligence (including gross) of the releasees or otherwise. 4. THE PERSON OR PERSONS AND/OR GUARDIAN hereby agrees to indemnify and save and hold harmless, PRO FLAGGERS, their owner(s), investor(s), business partner(s), the releasees and each of them from any loss, liability, damage, cost, and attorney fees they may incur due to the presence of the parent or the minor in the restricted area, or in any way while participating in the event and whether caused by negligence of the releasees or otherwise. The parent and/or guardian further recognize and agree they are executing this Waiver and Release of Liability and Indemnity Agreement on behalf of themselves and on behalf of the minor. THE PRO FLAGGERS CUSTOMER(S) AND/OR EVENT WORKER(S) AND/OR PERSON OR PERSONS, AND/OR GUARDIAN HAS READ AND AGREES TO THIS WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT AND DOES SO VOLUNTARILY AND WITH THE UNDERSTANDING THAT SUBSTANTIAL RIGHTS ARE BEING GIVEN UP AND ACKNOWLEDGES THIS FACT BY SELECTING "AGREE" IN THE "AGREE/DISAGREE TO TERMS" BOX FOR "PURCHASE WORKERS" AND/OR "SCHEDULE WORKER" FUNCTIONS RESPECTIVELY. This agreement is for all PRO FLAGGERS events at all locations world-wide. PRO FLAGGERS EVENT WORKERS: All PRO FLAGGERS "Event Workers" are INDEPENDENT PRIVATE CONTRACTORS and are NOT employees, customers or agents of PRO FLAGGERS. All PRO FLAGGERS "Event Workers" volunteer for or work directly for the various facilities and/or the various facilities customers renting or leasing the facilities and events they support. All PRO FLAGGERS "Event Workers" are compensated, if at all, directly by the various facilities and/or the various facilities customers renting or leasing the facilities and events they support and are NOT compensated in any way by PRO FLAGGERS. PRO FLAGGERS CUSTOMERS: PRO FLAGGERS CUSTOMERS ARE RESPONSIBLE for maintaining appropriate liability insurance to cover ALL PRO FLAGGERS "Event Workers" as required by both PRO FLAGGERS and any facility in use for any event world-wide. EVENT WORKER SCHEDULING FEE REFUNDS: No refunds will be made for PRO FLAGGERS "Event Workers" scheduling fees for any reason with the exception of no-shows. The scheduling fee(s) will be refunded for any single no-show on a per-worker per-day basis. Refunds for no-shows will be made directly to the PRO FLAGGER customer by reversing the charge for the individual(s) that no-show on a per-worker per-day basis. PRICING, ERRORS, ORDER and SPECIFICATIONS, PRO FLAGGERS reserves the right to change pricing and specifications at any time without notice, to correct any pricing errors, to refuse any orders for any reason and at any time. PRO FLAGGERS Code of Ethics, All volunteers and workers agree to abide by the PRO FLAGGERS Code of Ethics including: Maintaing a proper and professional manner at all times, respecting all people at all times including but not limited to fellow volunteers, workers, drivers, instructors, participants, crew, event and facility operators and managers, using only appropriate language at all times and with all communications devices, arriving well in advance of the start-time for all events and prepared for all weather possibilites, not to exit the facility at any time for any reason without the approval of the Eventmaster or other club official or PRO FLAGGERS Chief of Workers and to wear PRO FLAGGERS logo shirts and/or sweats as outerwear at all times, at their cost, weather permitting. Any and all parts of this Terms and Conditions and Waiver document(s) may be edited, updated, altered or changed at any time without notice.
